1. About these terms

These Terms of Service (“Terms”) govern your use of erievanguardsolutions.com, our phone line, and text messages from Erie Vanguard Solutions, LLC (“Erie Vanguard Solutions,” “EVS,” “we,” “us”), an Ohio limited liability company, PO Box 65, Ashland, OH 44805. By using our website, calling our line, or opting in to our text messages, you agree to these Terms and our Privacy Policy.

Businesses that hire us are also bound by a separate written service agreement. If that agreement conflicts with these Terms, the service agreement controls for that client.

2. Our services

EVS provides an AI phone receptionist and related automation for small businesses, including after-hours and overflow call answering, message taking, appointment booking, missed-call text-back, appointment reminders, follow-up messages, and alerts to clients. Website content, “starting at” prices, and sample calls are for general information only. Sample calls are simulated. Final pricing is confirmed in writing.

3. Founding offer and money-back guarantee

For our first 3 founding clients, the one-time setup fee is waived when the first month is paid in advance. New clients may cancel within 30 days of their service start date for a full refund of the first month’s fee. Usage over included minutes and third-party costs already incurred at the client’s request are not refundable. After that, service is month to month and may be cancelled as described in the client’s service agreement.

4. AI disclosure and call recording

Our AI receptionist identifies itself as an AI assistant. Calls may be recorded and transcribed, and the assistant announces this at the start of the call. By continuing the call, you agree to the recording and transcription. The AI can make mistakes. It is not a substitute for 911 or emergency services. In an emergency, hang up and dial 911.

5. SMS program terms

Program description	Erie Vanguard Solutions sends text messages about calls and appointments: missed-call text-backs, appointment confirmations and reminders, and follow-up messages to people who call our line or the small businesses whose phones we answer; replies to inquiries; and account and call alerts to our business clients.
How you opt in	(1) During a phone call, by asking for or agreeing to receive a text when our AI receptionist offers one. Your verbal consent is recorded. (2) On our website contact form, by checking the optional, unchecked-by-default SMS consent box. (3) For business clients, by providing a mobile number for alerts during onboarding. Consent is not a condition of purchase.
Message frequency	Message frequency varies based on your calls, appointments and requests.
Cost	Msg & data rates may apply. Contact your wireless carrier for details about your plan.
Opt out	Reply STOP to any message to cancel. You will receive one confirmation message and no further texts unless you opt in again. You may also opt out by contacting us.
Help	Reply HELP to any message for help, or email [email protected] or call (330) 227-2850.
Carrier liability	Carriers are not liable for delayed or undelivered messages.
Privacy	See our Privacy Policy. No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Text messaging originator opt-in data and consent will not be shared with any third parties.

You agree to tell us if you change or give up your mobile number. Message delivery is not guaranteed and may be affected by factors outside our control, including your device, coverage, and carrier.

6. No guarantee of results

We do not promise any specific number of calls answered, bookings, or revenue. Services depend on third-party telephone, messaging, and AI providers and may occasionally be interrupted.

7. Acceptable use

Do not misuse our website, phone line, or messaging services, attempt to break their security, submit false information, or use them for unlawful, harassing, or abusive purposes. Clients must use our services in compliance with applicable laws, including laws on call recording, telemarketing, and text messaging, and must obtain any consents required for the messages we send on their behalf.

8. Intellectual property

The website and its content are owned by EVS or its licensors. You may view and share it for personal or internal business purposes but may not copy or resell it without permission.

9. Disclaimers and limitation of liability

To the fullest extent permitted by law, our website and services are provided “as is” and “as available,” without warranties of any kind. EVS is not liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or data, arising from your use of the website, phone line, or text messages. Our total liability for any claim relating to these Terms will not exceed the greater of $100 or the amount you paid us in the 3 months before the claim.

10. Governing law

These Terms are governed by the laws of the State of Ohio, without regard to conflict-of-law rules. Any dispute will be brought in the state or federal courts located in Ohio, and you consent to their jurisdiction.

11. Changes

We may update these Terms from time to time by posting a new version on this page with a new “last updated” date. Continued use after an update means you accept the updated Terms.
